Meridian Retaining Walls helps Treasure Valley homeowners figure out whether a retaining wall needs a permit in Idaho, before the wall gets priced. Under the residential code Idaho has adopted, you don’t need a building permit for a wall up to 4 feet, measured from the bottom of the footing to the top of the wall, unless it supports a surcharge.
Look twice if your wall is close to that line, or if it holds up a driveway, a fence or a second tier. Several Treasure Valley cities also have rules for walls shorter than 4 feet. Call us with the city your lot is in, how tall the wall is and what sits above it, and we can talk it through.

- Permit line
- Over 4 ft from the bottom of the footing
- With a load above
- No exemption at any height
- Engineering
- Over 48 in of fill, or a wall over 24 in tall under a load
- Garden City cap
- 3.5 ft from the lowest adjacent grade, except next to the Boise Bench
Retaining walls that need a permit in Idaho

Retaining walls over 4 feet
Measure from the bottom of the footing. Past 4 feet, the permit exemption ends. Past 48 inches of unbalanced fill the adopted residential code also requires engineered design, covered under engineered retaining walls.

Walls under a driveway, patio or pool
Short walls that carry weight. A surcharge ends the permit exemption at any height, driveway retaining walls included.

Tiered retaining walls
Terraces up a slope. The block industry association treats tiered retaining walls as separate only when more than twice the lower wall’s height apart.

Walls on a lot line, or with a fence on top
If the yard drops off between you and the neighbors, check the plat for easements first. One block manufacturer’s guidance is that a fence should sit at least 3 feet behind a wall.

Retaining walls near a canal or ditch
For a lot on an irrigation easement. The Nampa & Meridian Irrigation District requires a license agreement for any encroachment by structures or landscaping, and other districts should be asked before anything is built near their easements. See retaining walls near canals.

Commercial retaining walls
Site walls and common-lot walls. The code for commercial retaining walls also ends its exemption at 4 feet from the bottom of the footing.

What does a retaining wall permit cost?
Each local row below is worked out from that office’s fee schedule for a wall of the value shown.
| Where | Fee | Source |
|---|---|---|
| Typical national range | $40 to $450 | National cost guides, October 2026 |
| Kuna, $8,000 wall | $133.10 before plan review | Small-structure permit table |
| Caldwell, $5,000 wall | $137.79: permit fee plus building plan review only | FY2026 fee schedule |
| Unincorporated Canyon County, $5,000 wall | $174 with plan review | Fee table adopted March 20, 2025 |
Local fees from the Kuna, Caldwell and Canyon County fee schedules. The national row is a typical range that shifts over time.
These are published fees, not a quote for your permit. What you pay depends on the value of the work, the city your lot is in and whether plan review is charged on top. Wall prices are on the retaining wall cost page.

How long does a retaining wall permit take?
It depends on the city. Caldwell says not more than 5 to 7 working days with a complete submittal. Star quotes 2 to 4 weeks for small residential review, plus 3 to 4 for each correction. Meridian’s last published figure, from 2021, is 7 to 10 business days from submittal to approval.
Digging runs on its own clock, permit or not. Idaho’s dig law says the one-number locating service has to get notice at least 2 and not more than 10 business days before anyone digs. If digging hasn’t started within three weeks, renew the ticket.
How is the 4 feet measured for a retaining wall permit?
From the bottom of the footing. Not from the lawn.
Idaho’s adopted residential code counts from the bottom of the footing to the top of the wall, and Meridian’s handout uses the same words. The height you see above the grass is only part of what the rule counts. The block industry association starts at the top of the leveling pad, buried block included. Near 4 feet? Ask your building office how it measures first.

Call and talk it through. Asking costs nothing.
What counts as a load above a retaining wall?
The code’s word for it is surcharge. The examples below come from outside guidance, so ask your own permit office what it counts.
- Driveways, patios and pools One block manufacturer calls any added weight above a wall a surcharge and names these three as the common residential ones.
- Slopes, parking and foundations A Virginia county’s checklist (April 14, 2021) adds slopes steeper than 3 to 1, parking areas, roadways and building foundations.
- Traffic and guardrails Federal rockery guidance counts both and treats traffic as 2 feet of extra soil.
Do tiered retaining walls count as one wall?
For design, yes, unless they’re far enough apart. The block industry association designs two tiers as one taller wall unless their faces stand more than twice the lower wall’s height apart. Two 2 foot walls need more than 4 feet between them; two 3 foot walls, more than 6.
When does a retaining wall need an engineer in Idaho?
The adopted residential code requires engineered design when a wall retains more than 48 inches of unbalanced fill, or when a wall is more than 24 inches tall and resists loads besides soil. Outside city limits, Canyon County’s checklist (revised January 12, 2026) requires it for walls taller than 4 feet from the bottom of the footing.
Idaho’s engineering board says those plans must be prepared by an Idaho licensee, even on your own lot (guidance dated January 23, 2026).
Retaining wall permit rules by city
The areas page has more on each place.

| Canyon County, unincorporated | Building Department, 111 N. 11th Ave, Room 310, Caldwell | Engineering over 4 ft from the bottom of the footing | May ask for the irrigation district’s written confirmation. |
Walls on a property line and fences on top of walls
Start with the plat, because easements run along lot lines. Meridian’s handout warns that a structure in an easement may have to be moved at the owner’s expense, and the city’s typical widths are on the Meridian lot-line rules page.
At corners, the state default vision triangle bars walls and fences between 3 and 10 feet high within 40 feet of an intersection. Local authorities may set their own standard.
Closer than 3 feet behind a wall, the block manufacturer’s guidance calls for a design professional, and posts set inside the block need an engineer.
What does the permit office look for in a retaining wall application?
- A registered contractor The state licensing agency says a contractor without registration cannot obtain a building permit.
- Stamped plans, where engineering applies Eagle and Garden City ask for an Idaho engineer’s stamped calculations on walls more than 4 feet from footing to top.
- Locate ticket State law again: notice goes in 2 to 10 business days before any digging.
